Who we are
These Terms of Use apply to flexlogix.io and its forms. "Flexlogix", "we" and "us" mean the operator of the site. "Operator" means a warehouse owner or 3PL that lists space. "You" means the business using the site.
Flexlogix is a marketplace
Flexlogix is an online marketplace. We are not a real estate broker, landlord or party to any space agreement. Listings, prices and terms come from the operator.
Nor are we a real estate salesperson, agent or licensor. We do not negotiate, show space, hold or reserve space, take deposits or collect rent. Any space agreement, deposit and payment is between you and the operator. We route your inquiry to the operator you choose, and the operator replies directly.
Business use only
The site is for businesses. By using a form you confirm you are acting for a business, not for personal, family or household use.
Listings belong to the operator
Each listing, including its price, inclusions, facts, photos and terms, is the operator's own statement, shown as the operator stated it, with the date the operator confirmed it. We do not warrant that a listing is accurate, complete or available. A listing is called "verified" only when Flexlogix holds a stored inspection record for it.
Estimates
Floor-area sizes, ranges and "Estimated fit" labels are estimates from the numbers you enter. They are not a measurement of your goods, a rack design or an approval of your use. Confirm sizes, access and permitted use with the operator.
Prohibited uses
Do not store or ask to store hazardous materials, lithium-ion batteries or goods requiring high-piled storage unless the listing expressly allows them. Do not use the site for illegal goods or activities, to misrepresent who you are, to scrape or overload the site, or to contact operators for anything other than a genuine space inquiry.
No warranties; limitation of liability
The site and listings are provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
To the extent the law allows, Flexlogix is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability to an operator is capped at the fees that operator paid Flexlogix in the 12 months before the claim.
Disputes
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
Changes and contact
We announce changes by posting a new version on this page with its date. When the Terms change, we ask you to accept the new version on your next request. Contact: hello@flexlogix.io.
